Terms and Conditions (T&C)

Last updated: October 2026

1. Scope

These Terms and Conditions apply to all contracts concluded between the owner LIANG Hongji (hereinafter “the seller”) and you as customer (hereinafter “the buyer”) via the online shop mosscrystal.com. Deviating terms of the buyer are not recognised unless the seller expressly agrees to them in writing.

2. Contracting party

Seller: MossCrystal – LIANG Hongji, sole proprietorship (registered name: 梁鸿基)
Address: No. 126 Huagui Road, Liwan District, Guangzhou, Guangdong Province, China
WeChat: Niredk_y | Email: service@mosscrystal.com

3. Formation of the contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order (invitatio ad offerendum). By submitting the order via the “Buy now” button, the buyer makes a binding offer to purchase the goods in the cart. The purchase contract is concluded when the seller confirms the order by order confirmation by email.

4. Prices and shipping costs

All prices are in euro (€). Prices on the website are subject to change – the price shown at the time of order applies. Shipping costs are payable separately and are displayed during checkout. International shipments may be subject to customs duties and import VAT (EUST) of the destination country; these costs are borne by the buyer.

5. Payment

Payment is made via the payment methods offered in the order process. The seller reserves the right to reject individual payment methods. For payment by PayPal or credit card, the charge is made when the order is completed.

6. Delivery

Delivery is made to the delivery address given by the buyer. The expected delivery time is displayed during checkout. For shipments abroad (outside the EU or Germany) longer delivery times and customs clearance times may occur. The seller is not liable for delays caused by customs or the transport provider.

7. Right of withdrawal (returns)

Consumers in the EU: under EU consumer law you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day on which you or a third party named by you take possession of the goods. To exercise your right of withdrawal, you must inform us (service@mosscrystal.com) by means of a clear statement (e.g. an email) of your decision to withdraw.

Consequences of withdrawal: if you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs, without undue delay and at the latest within 14 days. For this repayment we use the same means of payment that you used in the original transaction. The goods must be returned unused, undamaged and in the original packaging. The buyer bears the return shipping costs unless the goods are faulty.

Excluded from returns: goods made to measure or clearly tailored to your personal requirements are excluded from returns. Gemstones and crystals may differ slightly in colour, size and pattern from the product images because they are natural products – this is not a defect.

8. Warranty and defects

The statutory warranty rights apply. In the event of defects in the goods you have the right to subsequent performance (replacement delivery or repair) or to withdraw from the contract. Natural variations in colour, transparency and size of gemstones and crystals are typical material properties and do not constitute defects. The product images on mosscrystal.com are for guidance only; the stone delivered may differ from the photo.

9. Retention of title

The goods delivered remain the property of the seller until full payment has been made.

10. Liability

The seller is liable for damages only in cases of intent or gross negligence. For slight negligence the seller is liable only for breach of a material contractual obligation (cardinal obligation), with liability limited to the typical, foreseeable damage. Liability under product liability law and for damage to life, body and health remains unaffected.

11. Data protection

Your personal data is collected and processed in accordance with our privacy policy (see: Privacy policy).

12. Governing law and dispute resolution

The law of the People’s Republic of China applies. For consumers within the EU, the mandatory consumer protection law of their home country remains unaffected. The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. The seller is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

13. Final provisions

Should any provision of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
